Class Action Lawsuit Filed Against Porsche Alleging Dangerous Battery Defect in Taycan Electric Vehicles by Gibbs Law Group

Alleged Dangerous Risk of Fire from Short Circuiting Batteries; Nearly All Taycan 2020-2024 Models Have Been Recalled

Gibbs Law Group has filed a class action lawsuit against Porsche for allegedly failing to disclose or adequately repair a dangerous defect in the 800V lithium-ion batteries equipped in Porsche’s Taycan electric vehicles (EVs), model years 2020-2024. According to the lawsuit, the defect may cause the batteries to lose power and worse, short circuit, creating the risk of a fire. The lawsuit is titled Kukrika et al. v. Porsche Cars N.A., Inc., Case 1:24-cv-05492-ELR and is pending in the Northern District of Georgia.

What is the alleged battery defect in Porsche Taycans?

As early as 2020, there were news reports of a Porsche Taycan spontaneously catching fire while parked in a residential garage. Numerous Taycan owners have filed complaints with the National Highway Traffic Safety Administration (NHTSA) about experiencing problems with the battery. NHTSA complaints describe a sudden loss of power while driving on a highway and being forced to pull over after seeing the warning, “Electrical System Error / Park Vehicle in Safe Place.”

A NHTSA report states that Porsche has learned of other battery fires in Taycan vehicles after being charged.

Who can join the Porsche Taycan Battery Defect Class Action Lawsuit?

Owners and lessors of almost all Taycan model years 2020-2024 purchased from Porsche dealers may be able to join. Models that are suspected to be affected by the battery defect include:

Receive a recall notice for your Porsche Taycan?

Porsche first began issuing recalls in December of 2023 and has since expanded its recall to nearly all Taycan models. The lawsuit alleges that the recalls do not address the root cause of the defect, and that Porsche has not agreed to affirmatively repair or replace all the defective batteries at this time.

Pursuant to the recall, Porsche says it will install a software update that will allow it to monitor data from the electric batteries to determine if there are any anomalies. The update, however, will not be available until sometime during the first quarter of 2025. Porsche is asking many Taycan owners to limit charging capacity to 80%, which means Taycan owners won’t receive the advertised range per charge and will have to charge their batteries more often.
